Are digital peepholes with cameras legal?
Regulations and key points for your home on the Costa del Sol
At Narixa Villas, specialists in real estate management in Nerja, Frigiliana, Torrox and the whole Axarquía, your safety and peace of mind at home are our priority. Today we explain what you need to know about the recent ruling from the Spanish Supreme Court, which clarifies what is allowed—and what is not—when installing a digital peephole with a camera on your front door.
Digital peephole and privacy: What the Supreme Court says
The Supreme Court has ruled that installing a digital peephole with a camera that records or captures images of neighbors in the hallway may infringe on their right to privacy.
A recent case in Madrid forced a couple to remove their device and pay compensation, as the camera was recording neighbors when they opened their doors—something not justified as a safety measure.
In short: even if the technology only activates by motion, if it affects third parties, it is not legal.
Are digital peepholes legal in Spain?
Yes, but under very clear conditions:
- The field of vision must be limited exclusively to your own doorway, without recording common areas.
- There must be a real security reason, not just convenience.
- You must comply with data protection laws (GDPR and LOPDGDD): inform neighbors, restrict access to recordings, and protect files properly.
Cameras in common areas of buildings
The Supreme Court also reminded that cameras can be installed in common areas such as hallways or garages, but only if the homeowners’ association approves it by a qualified majority (3/5) and image management complies with the law.
Tips to improve home security in Nerja and La Axarquía
If you want to enhance the security of your Costa del Sol property without breaking the law:
- Use alarms connected to a security monitoring center.
- Install indoor motion sensors instead of cameras recording third parties.
- Always consult a real estate or legal professional before installing an electronic peephole with a camera.
While digital peepholes with cameras can be useful, when misused they represent a legal risk and potential financial penalties.
At Narixa Villas, we advise you to ensure your holiday rental or permanent residence in Nerja, Torrox, Frigiliana or anywhere in La Axarquía has security measures that are legal, effective and respectful towards your neighbors.
